hereinafter referred to as “DirektHost”, “the Provider”, “we”, “us” or “DOW MEDIA SRL”.
These Terms govern the use of DirektHost.eu, the customer portal, and the services provided by DirektHost.
They also contain provisions regarding the processing and protection of personal data in connection with our hosting services.
By creating an account, accepting a quotation, ordering or activating a service, or otherwise expressly accepting these Terms, the Customer confirms that they have read, understood and agreed to them.
PART I – TERMS AND CONDITIONS
1. Definitions
For the purposes of these Terms:
Customer means any natural person or legal entity ordering or using one or more DirektHost services.
User means any person accessing DirektHost.eu, the Client Area, a hosting control panel or any service provided by DirektHost.
Client Area means the platform available at my.DirektHost.ro, through which Customers may manage services, invoices, payments, support requests and other account-related operations.
Service means any service supplied by DirektHost, including but not limited to Managed Cloud Hosting, Cloud Storage, virtual servers, domain registration and management, SSL certificates, backup services, server administration, migrations and technical support.
Account means the Customer account, hosting account, Cloud environment, server or any other resource made available to the Customer.
Content means files, databases, email messages, images, text, applications, logs and any other information stored, transmitted or processed through the Services.
Managed Service means a service for which DirektHost provides the server-level management specified in the commercial offer applicable to that Service.
Consumer means a natural person acting for purposes outside their trade, business, craft or profession.
2. Scope of the Services
DirektHost provides hosting and related technical services according to the specifications presented in the relevant commercial offer.
The specific characteristics of each Service may include:
- CPU resources;
- RAM;
- storage capacity;
- network capacity;
- control panel;
- backup;
- monitoring;
- server management;
- SSL certificates;
- migration assistance;
- other technical features.
The characteristics applicable to a Service are those stated in the offer valid when the Service is ordered or accepted.
An order may be initiated through DirektHost.eu, the Client Area, email, support system or other communication methods made available by DirektHost.
These Terms, the commercial offer and any specific conditions expressly agreed with the Customer together form the contractual relationship between DirektHost and the Customer.
Where a specific Service has special terms that conflict with these general Terms, the specific Service terms shall prevail for that Service.
3. Account Creation, Orders and Service Activation
A Customer account may be required for the administration of Services.
Customers must provide complete, accurate and up-to-date information.
Customers are responsible for keeping account credentials confidential and for activity performed through their accounts.
DirektHost may request additional information where reasonably necessary for:
- order verification;
- fraud prevention;
- legal compliance;
- domain registration;
- invoicing;
- service delivery;
- security.
An order becomes binding when accepted or confirmed by DirektHost.
Service activation may depend on:
- acceptance of a quotation;
- confirmation of payment;
- verification of Customer information;
- technical feasibility;
- completion of any specific formalities.
Certain operations may be automated, while others may require manual review or technical discussion.
DirektHost may refuse an order where there are reasonable indications of fraud, illegal use, abusive activity, false information or unacceptable risk to the infrastructure.
4. European Customers and Pre-Service Consultation
DirektHost.eu is primarily intended for European businesses, organisations, professionals and consumers.
Managed hosting is not always suitable for every technical environment.
For migrations or more complex configurations, DirektHost may recommend discussing the Customer’s existing infrastructure before activation.
Information requested may include:
- current hosting provider;
- existing CPU and RAM resources;
- storage usage;
- number of websites;
- email storage;
- databases;
- current control panel;
- application requirements;
- migration requirements.
Such consultation does not oblige DirektHost to accept a project and does not oblige the Customer to purchase a Service.
5. Prices, Currency, VAT and Payment
Service prices are those displayed on DirektHost.eu, stated in the Client Area, or communicated to the Customer in a quotation or order confirmation.
Prices displayed in EUR on DirektHost.eu may be indicative where direct EUR ordering is not available.
The binding price, invoicing currency, applicable VAT treatment and payment conditions are those stated in the final quotation, order confirmation or invoice.
VAT is applied in accordance with applicable tax legislation and may depend on:
- Customer country;
- Customer status;
- VAT registration status;
- place-of-supply rules;
- other legally relevant information.
Services are normally paid in advance for the contracted period.
Invoices, pro forma invoices and service notifications may be sent electronically and/or made available in the Client Area.
The Customer is responsible for keeping their billing and contact information current.
A pro forma invoice does not constitute confirmation that payment has been received.
6. Service Renewal
Services are provided for the period that has been paid for.
Renewal is required for continued use unless automatic renewal has been expressly agreed.
DirektHost may send reminders by email or through the Client Area.
Such reminders are provided as a convenience.
The Customer remains responsible for monitoring expiry dates and paying renewal fees on time.
Failure to receive a reminder does not transfer renewal responsibility to DirektHost.
7. Suspension for Non-Payment
If payment is not received by the due date, DirektHost may suspend the Service.
The Service may be reactivated after full payment of outstanding amounts.
Services that remain unpaid for an extended period may be terminated and associated data may be deleted.
As a general operational practice, unpaid Services may be deleted approximately 30 days after suspension, but this period is not a contractual guarantee of data retention.
Once data has been deleted, recovery is not guaranteed.
If recovery from an older backup is technically possible, restoration may be subject to an additional charge communicated before the work is performed.
8. Customer Responsibilities
The Customer is responsible for:
- providing accurate and current information;
- protecting login credentials;
- protecting passwords and SSH keys;
- activity conducted through their Services;
- Content stored or transmitted through the Services;
- compliance with applicable law;
- maintaining the security of applications under their control;
- keeping applications, plugins, modules and themes up to date;
- maintaining independent copies of data considered important.
The Customer must notify DirektHost without undue delay if unauthorised access or compromise of a Service is suspected.
ACCEPTABLE USE
9. Acceptable Use Policy
DirektHost Services may not be used for activities contrary to:
- Romanian law;
- European Union law;
- the law applicable to the Customer;
- the law applicable at the infrastructure location;
- mandatory registry or network rules.
Prohibited uses include, without limitation:
- malware distribution;
- ransomware;
- viruses or trojans;
- phishing;
- identity theft;
- credential theft;
- unauthorised system access;
- cyberattacks;
- illegal spam;
- mail bombing;
- fraudulent communications;
- pirated software distribution;
- illegal Content;
- infringement of intellectual property rights;
- abusive public proxies;
- infrastructure designed primarily to conceal abusive activity;
- unauthorised cryptocurrency mining;
- activity that materially harms the infrastructure or other customers.
DirektHost may immediately restrict or suspend a Service where there are reasonable grounds to believe that it poses a security, legal or operational risk.
Where circumstances reasonably allow, the Customer will be informed and given an opportunity to remedy the issue.
10. Resource Usage
DirektHost Cloud services provide the resources stated in the relevant commercial offer.
Where a plan is advertised as supporting unlimited websites, domains, email accounts or databases, “unlimited” refers to the number of items that may be created and does not mean unlimited computing resources.
Actual capacity remains subject to:
- allocated CPU;
- allocated RAM;
- storage;
- network capacity;
- technical limitations;
- acceptable use rules.
Customers may use their allocated resources for multiple projects, provided that the use does not create security or operational risks.
Where resource consumption persistently exceeds the capacity of the selected Service, DirektHost may recommend optimisation or migration to a larger configuration.
11. Cloud Hosting Storage Usage
Cloud Hosting plans are primarily intended for websites, email, databases, web applications and associated hosting Content.
They are not automatically intended to operate as:
- public file distribution platforms;
- large-scale streaming services;
- CDN services;
- public file-sharing networks;
- unrelated bulk storage repositories;
unless such usage has been expressly agreed.
Customers whose primary requirement is large storage capacity may be directed to DirektHost Cloud Storage.
12. Cloud Storage Usage
Cloud Storage Services are designed for larger storage requirements and may be used for hosting-related files, email, archives, websites, databases and other permitted business data.
Cloud Storage does not constitute unlimited storage.
The Customer may use storage up to the capacity included in the selected plan.
Specific technical restrictions may apply to unusually large files, excessive numbers of filesystem operations, abusive automated processes or use that threatens infrastructure stability.
13. Background Processes and Scheduled Tasks
Background processes and scheduled tasks must be configured responsibly.
DirektHost may restrict or terminate processes that:
- consume disproportionate resources;
- generate abnormal disk activity;
- create network abuse;
- present a security risk;
- affect infrastructure stability.
Any specific scheduling or process limits communicated for a Service form part of the Service conditions.
14. Email and Anti-Spam Policy
DirektHost infrastructure may not be used to send spam, mail bombing or unlawful unsolicited commercial communications.
Customers using mailing lists must have a valid legal basis for sending the messages and must provide unsubscribe mechanisms where required by applicable law.
DirektHost may impose limits on:
- outgoing email volume;
- recipients;
- SMTP connections;
- automated script-generated messages.
These limitations protect:
- IP reputation;
- email deliverability;
- infrastructure stability;
- other Customers.
If spam or compromise is detected, email functionality or the affected Service may be restricted or suspended immediately.
SECURITY
15. Websites and Application Security
The Customer remains responsible for applications installed or operated by the Customer, including:
- CMS platforms;
- WordPress;
- WooCommerce;
- plugins;
- modules;
- themes;
- custom software.
DirektHost may detect, isolate, restrict or block suspicious files where necessary to protect the infrastructure.
Detection of a compromised website does not automatically create an obligation for DirektHost to repair the application free of charge.
Malware removal, application repair, programming, code changes and application maintenance may constitute separate paid services unless included in the relevant Managed plan.
16. Server Management
For Managed Services, DirektHost provides the server-level management included in the selected plan.
This may include, depending on the Service:
- initial system configuration;
- hosting service configuration;
- operating system updates;
- service monitoring;
- technical maintenance;
- intervention in infrastructure-related incidents.
Managed Service does not automatically include:
- website development;
- application programming;
- third-party plugin debugging;
- custom application administration;
- malware cleanup;
- application-level optimisation;
- development work;
unless expressly included or separately agreed.
BACKUP
17. Backup
Where backup is included in a Service, copies are created according to the technical backup policy applicable to that Service.
DirektHost backup is an additional protection measure.
It does not replace the Customer’s responsibility to keep independent copies of important data.
DirektHost cannot guarantee that every backup can be successfully restored in every possible situation.
Customers are encouraged to maintain independent backup copies outside the primary hosting infrastructure.
18. External Backup
Where a Managed Cloud plan specifically includes external backup, backup data is stored separately from the primary Service according to the applicable technical configuration.
Retention periods, backup frequency and restoration options may vary according to the Service.
Backup availability does not constitute an absolute guarantee against data loss.
SERVICE AVAILABILITY
19. Availability
DirektHost aims to maintain a high level of service availability and, for standard hosting infrastructure, targets approximately 99.9% average infrastructure availability under normal operating conditions.
The following may be excluded from availability calculations:
- scheduled maintenance;
- emergency maintenance;
- cyberattacks;
- DDoS attacks;
- third-party provider failures;
- software issues outside DirektHost’s reasonable control;
- external DNS failures;
- communication network failures;
- Customer application failures;
- suspension resulting from contractual violations;
- force majeure events.
Unless a separate SLA is expressly provided, this target does not constitute a financial service-level guarantee.
SUPPORT
20. Technical Support
Customers may request support using the channels provided by DirektHost.
For technical issues, support tickets are the preferred method because they allow the technical team to review logs, configuration and service history.
Support may be requested through the Client Area.
Standard infrastructure support does not automatically include:
- web development;
- programming;
- website modifications;
- third-party software debugging;
- malware cleanup;
- content management;
- tasks outside the scope of the contracted Managed Service.
21. Support Language
DirektHost.eu provides customer communication and support in English.
Other languages may be available at DirektHost’s discretion but are not guaranteed unless expressly agreed.
DOMAINS
22. Domain Registration
DirektHost may facilitate the registration, renewal, transfer and administration of domain names.
The Customer must provide accurate, complete and current information for the domain holder.
Where permitted by the relevant registry rules, the domain will be registered using the holder information supplied by the Customer.
Incorrect or false information may result in:
- registration failure;
- suspension;
- transfer difficulties;
- inability to recover the domain;
- revocation or loss of use rights where permitted by registry rules.
23. Domain Availability
A domain shown as available on DirektHost.eu or in a registration interface is not guaranteed to remain available.
Registration is completed only after confirmation by the relevant registrar or registry.
DirektHost is not responsible if another person registers the domain before the Customer’s registration request is successfully processed.
24. .EU Domains
.eu domain registrations are subject to the rules and policies of EURid, the registry responsible for the .eu top-level domain.
The Customer must satisfy the eligibility requirements applicable to .eu domain holders.
These generally include eligible citizens, residents, companies and organisations connected to the European Union, Iceland, Liechtenstein or Norway.
The Customer is responsible for maintaining eligibility for the duration of the registration.
Where EURid rules conflict with these Terms in relation to a .eu domain, the mandatory EURid rules prevail.
25. .COM and Other Domain Extensions
.com domains and other international extensions are subject to the terms, policies and procedures of the relevant registries and registrars.
Registration, renewal, transfer, redemption and other procedures may therefore vary between extensions.
Certain deadlines, restrictions and fees are controlled by third parties and cannot be modified by DirektHost.
26. Choosing a Domain Name
The Customer is responsible for selecting the domain name.
The Customer must ensure that registration and use of the requested domain do not unlawfully infringe:
- trademarks;
- trade names;
- copyrights;
- personal rights;
- other third-party rights.
DirektHost is not required to perform trademark or legal clearance searches before domain registration.
27. Domain Renewal
The Customer is responsible for renewing domains before expiry.
DirektHost may send renewal reminders, but such reminders are a convenience only.
Failure to receive a reminder does not transfer renewal responsibility to DirektHost.
After expiry, a domain may:
- stop functioning;
- enter a grace period;
- enter redemption;
- incur additional recovery fees;
- become available for registration by another party.
DirektHost cannot guarantee recovery of an expired domain.
28. Domain Fees and Refunds
Once a domain registration, renewal or transfer has been successfully submitted to or completed by the relevant registry or registrar, the associated cost is generally non-refundable.
This clause does not restrict mandatory consumer rights that cannot legally be excluded.
CANCELLATION AND WITHDRAWAL
29. Commercial Money-Back Guarantees
A commercial money-back guarantee applies only where expressly stated in the Service offer.
Unless the offer states otherwise, such guarantees do not automatically apply to:
- domains;
- third-party licences;
- third-party certificates;
- Cloud infrastructure;
- server administration;
- migrations;
- technical work;
- services involving non-refundable third-party costs.
Any commercial guarantee is additional to mandatory consumer rights.
30. Consumer Right of Withdrawal
A natural person qualifying as a Consumer may benefit from statutory withdrawal rights for distance contracts under applicable consumer legislation.
The standard EU withdrawal period for service contracts is generally 14 days from conclusion of the contract, subject to applicable exceptions.
Where the Consumer expressly requests that Service performance begin during the withdrawal period, the Consumer may be required to pay for the proportion of the Service already provided if they subsequently withdraw.
Where a Service has been fully performed with the Consumer’s prior express consent and acknowledgement, the withdrawal right may cease in accordance with applicable law.
For operations carried out immediately, including certain domain registration operations, DirektHost may request the Consumer’s express consent to begin performance before the withdrawal period expires.
Where required by law, DirektHost will provide an appropriate method for exercising the withdrawal right.
31. Customer Cancellation
The Customer may request non-renewal or termination of a Service using the Client Area or another contact method made available by DirektHost.
Termination may lead to permanent deletion of:
- websites;
- files;
- databases;
- email accounts;
- configurations.
Customers must create any required backup before termination.
32. Suspension or Termination by DirektHost
DirektHost may suspend or terminate a Service in cases including:
- non-payment;
- illegal use;
- spam;
- cyberattacks;
- malware;
- serious abuse of resources;
- infringement of third-party rights;
- intentionally false information;
- security compromise;
- serious or repeated violation of these Terms.
Where urgent action is necessary for security or legal reasons, suspension may occur without prior notice.
LIABILITY
33. Limitation of Liability
DirektHost will use reasonable efforts to provide stable and secure Services.
To the maximum extent permitted by law, DirektHost is not liable for indirect damages, loss of profit or losses resulting from circumstances outside its reasonable control.
DirektHost is not responsible for losses caused by:
- Customer applications;
- vulnerabilities in Customer-controlled software;
- compromised credentials attributable to the Customer;
- configurations made by the Customer or third parties;
- accidental deletion by the Customer;
- failure to maintain independent backups.
To the extent permitted by law, DirektHost’s aggregate liability for direct damages associated with a specific Service will not exceed the amount actually paid by the Customer for that Service during the 12 months preceding the event giving rise to liability.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
34. Force Majeure
DirektHost is not liable for failure or delay caused by events outside its reasonable control, including events qualifying as force majeure under applicable law.
35. Changes to the Terms
DirektHost may update these Terms to reflect:
- legal changes;
- technical changes;
- security requirements;
- commercial changes;
- new Services.
The current version will be published on DirektHost.eu and/or made available through the Client Area.
Material changes will be communicated where required by law or by the nature of the change.
GOVERNING LAW
36. Applicable Law
The contractual relationship with DOW MEDIA SRL is governed by Romanian law, subject to mandatory provisions of European Union law.
Where the Customer is a Consumer and DirektHost directs its commercial activities to the country in which that Consumer has their habitual residence, this choice of Romanian law does not deprive the Consumer of mandatory protections that would otherwise apply under the law of that country.
The parties will first attempt to resolve disputes amicably.
Consumers may also use the competent consumer protection authorities, alternative dispute resolution mechanisms and courts available to them under applicable law.
PART II – DATA PROCESSING TERMS FOR HOSTING SERVICES

45. Data Subject Requests
Taking into account the nature of the processing, DirektHost will provide reasonable assistance to the Customer where required for responding to requests from data subjects concerning hosted personal data.
The Customer remains responsible for determining how to respond to such requests.
46. Security Incidents
Where DirektHost becomes aware of a personal data breach involving data processed on behalf of the Customer, DirektHost will notify the Customer without undue delay after becoming aware of the incident.

- security of processing;
- personal data breaches;

where such obligations relate directly to the Services provided by DirektHost.

48. Information and Audits
DirektHost will make available information reasonably necessary to demonstrate compliance with its obligations as a processor under applicable data protection law.
Where legally required, DirektHost will reasonably cooperate with audits or inspections relating to the processing performed on behalf of the Customer.
Audits must be:
- proportionate;
- reasonably scheduled;
- subject to confidentiality;
- conducted so as not to compromise other customers, infrastructure security or confidential information.
Where permitted by law, extraordinary audit-related costs may be charged to the Customer.
49. Return and Deletion of Data
Upon termination of the Service, Customer data may be deleted from active systems.
At the Customer’s request and where technically available before deletion, the Customer may retrieve or export data using the normal Service functions.
Data may remain temporarily in backups until the normal backup retention cycle expires.
DirektHost may retain data where required by Union or Member State law.
50. International Transfers for Hosted Data
DirektHost aims to use European infrastructure for DirektHost.eu Services.
If processing by a provider requires personal data to be transferred outside the European Economic Area, DirektHost will use an appropriate legal transfer mechanism where required, such as:
- an adequacy decision;
- Standard Contractual Clauses;
- another lawful GDPR transfer mechanism.
